Privacy Policy

This Privacy Policy explains how EsseMC Pty Ltd collects, uses, shares and protects personal information when you use https://www.essemc.com/ and its assessment tools. It applies worldwide; some sections give extra rights depending on where you live.

1. Who we are

EsseMC Pty Ltd (ABN 15662336423), 114 Dodds St., Melbourne, Australia, is responsible for your personal information when you register directly. When an organisation (a Sponsor) invites you to an assessment, we process your information on its behalf for that assessment. Privacy contact: hello@essemc.com.

2. Information we collect

3. How we use your information

  • To create your result on the basis of your responses, deliver, and score assessments, and issue Results.

  • To verify identity and protect the integrity of assessments.

  • To send Results to Sponsors or others you choose.

  • To provide customer support, process payments and handle complaints and reviews.

  • To maintain security, prevent fraud and meet legal obligations.

  • For research, as described in section 4.

  • To send service messages and, with your consent, marketing you can opt out of at any time.

4. Research use

We may use assessment responses, timing data and Results for research, including validating and improving our assessments, building norms, monitoring fairness, and supporting academic or industry studies. Before research use, we remove or irreversibly code anything that identifies you. Your personal information will not be revealed in any study, report, publication or shared dataset. Findings are reported only in aggregate or de-identified form. Research partners receive only de-identified data and must contractually agree not to re-identify anyone. Where local law requires consent for research, we ask for it separately; saying no does not affect your assessment or Results.

5. Legal bases (EEA, UK and similar laws)

We rely on performance of our contract with you, our legitimate interests (integrity, security, fraud prevention, improving assessments and de-identified research), compliance with legal obligations, and your consent where required, including for biometric verification, special-category data and marketing. You may withdraw consent at any time without affecting earlier processing.

6. Automated decision-making

Scoring is largely automated. Where a decision with legal or similarly significant effect is made solely by automated means, you may ask for human review, give your view and contest the decision.

7. Who we share information with

  • Sponsors that invited you, or recipients you choose, who receive your Results.

  • •Service providers for hosting, payments, email and support, bound by contracts to protect your data.

  • Research partners, who receive de-identified data only.

  • Authorities or advisers where required by law or to protect rights and safety.

  • A buyer or successor in a business sale, on equivalent privacy terms.

We do not sell or rent your personal information, or share it for cross-context behavioural advertising.

8. International transfers

We operate globally and may store or access data in [list countries/regions]. When transferring data out of the EEA, UK, Switzerland, Australia or other countries with transfer rules, we use adequacy decisions, Standard Contractual Clauses, the UK Addendum or other lawful safeguards, and take reasonable steps to ensure overseas recipients protect it.

9. Security

We use encryption in transit and at rest, access controls, staff training, regular testing and supplier due diligence. No system is perfectly secure; we will notify you and regulators of a data breach where the law requires.

10. Retention

11. Your rights

Depending on where you live, you may have the right to access, correct, delete, restrict or object to processing of your information, to data portability, to withdraw consent, and to opt out of sale, sharing or targeted advertising (we do none of these). California and other US state residents may also limit use of sensitive personal information and will not be discriminated against for exercising rights. Email hello@essemc.com; we may need to verify your identity and will reply within the time the law sets. Where we act for a Sponsor, we may pass your request to it.

12. Complaints

Contact us first. You may also complain to your local regulator, such as the Office of the Australian Information Commissioner, an EU supervisory authority, or the UK Information Commissioner's Office.

13. Children

The Website is not intended for children under 16 without consent and supervision from a parent or guardian, and only where a Sponsor such as a school has arranged it. We do not knowingly collect children's information otherwise.

14. Cookies

We use essential cookies to run the Website and secure assessments.

15. Changes to this policy

We will post updates here and notify you of material changes by email or on the Website at least [30] days before they take effect.
